Expungements
In many states, through a process called expungement, you can petition the court to have your criminal record sealed or erased. Often employers, landlords, schools, credit agencies and others can request a copy of your criminal record which will show both arrests and convictions. If an expungement is granted you will have been given a second chance for your future.
The laws surrounding expungement vary depending on the state. There may be differences based on whether the charges were dismissed or if there was an acquittal or conviction. Also, the nature of the crime, either felony or misdemeanor, will often determine the availability of an expungement.
Appeals and Writs
We work with clients who are seeking to appeal a conviction or the trial court's sentencing decision. There are strict time constraints after a conviction in which to file an appeal, so contacting an attorney quickly is very important. In addition to appeals, we can file writs to challenge the outcome of a criminal case or sentence.
Pardons
If expungement is not available another options is to ask for a pardon. The Governor of Illinois has the power through executive clemency to grant a pardon to forgive the crime or commute a sentence. This can be either a partial or full reduction of the sentence.
